Heard learned counsel for the applicant, learned AGA for the State and perused the record.

The present anticipatory bail application has been filed by the applicant in relation to FIR/Case Crime No.0197/2025, under Sections 166, 167, 506 of I.P.C. and Section 7, 11, 12 of the Prevention of Corruption Act, Police Station - Sandila, District - Hardoi.

The submission of learned counsel for the applicant is that the applicant is innocent and has been falsely implicated in the case. Learned counsel for the applicant has further submitted that a perusal of the contents of F.I.R. would indicate that specific allegation with regard to attract the offence of the Prevention of Corruption Act, 1988 (in short "Act of 1988") have been leveled by the opposite party No.2 against one Sudhir Kumar, R.K., Tehsil-Sandila, who despite the order of correction dated 27.02.2024 failed to carry out the necessary correction in the records, as per opposite party No.2 for not providing him Rs.10,000/- for the said purpose.

It is also submitted that initially order dated 27.09.2022 was corrected on 27.02.2024 which was not incorporated in the relevant records by Sudhir Kumar and subsequently he was transferred and on his place the applicant joined on 10.07.2024 and on coming to know about the order dated 27.02.2024 the applicant made correction in the revenue records within the reasonable time and thereafter the informant again moved an application seeking correction in the order dated 22.09.2022 read with order 27.02.2024 and this application was allowed vide order dated 28.05.2025 and immediately thereafter the necessary corrections were incorporated by the applicant in the revenue records.

It is lastly stated that according to the affidavit of the informant given to the concerned police officer, which is annexed as Annexure No.8 to the present

application, the applicant has not committed any crime as at the relevant point of time when the order dated 27.02.2024 was passed whereby the order dated 27.09.2022 was corrected the applicant was not posted.

Taking note of the aforesaid, as an interim measure, it is provided that in the event of arrest, the accused-applicant - Bandhulal be released forthwith in the aforesaid case crime on anticipatory bail on her furnishing a personal of Rs.25,000/- and two sureties in the like amount to the satisfaction of Station House Officer of the Police Station/Court concerned with the following conditions:-

(i) That the accused-applicant shall make himself available for interrogation by police authorities as and when required and will cooperate with the investigation;

(ii) That the accused-applicant shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer; and

(iii) That the accused-applicant shall not leave India without the previous permission of the Court.

List/put up this application in the first week of November, 2025.

In the meantime, learned A.G.A. shall file counter affidavit.
