Learned counsel for the applicant submits that as per allegations, the applicant and his three co-accused persons collectively caused injuries to the injured Ganga Sagar, Shiv Bhagawan and Shiv Rani, but none of the injuries suffered by the injured was declared as "dangerous to life".
Learned counsel for the applicant has drawn attention of the Court to the Medico Legal Reports (Annexure No.3) of the injured to point out that as per the opinion of the doctor, the alleged injuries were found to be simple, therefore, according to him the offence punishable under Section 109(1) B.N.S. would not be made out. He further states that the co-accused, namely, Saktu and Shiv Kumar have already been extended to the concession of regular bail.
Issue notice the opposite parties.
As this stage, Sri Virendra Kumar accepts notice of the State and prays for time to seek instructions.

Meanwhile, in the event of arrest of the applicant-Uttam, it is ordered that arresting officer/ investigating officer shall release him on interim bail subject to his furnishing the requisite bail bonds. The applicant shall join the investigation as and when required, who shall also abide by the conditions enshrined in Section 482 (2) BNSS.
