Learned counsel for the applicant submits that the F.I.R. has been registered after a year and three months, wherein the complainant has alleged that heavy vehicle (Truck bearing No. UP36-T-9494) owned by him was given on rent to accused Babu Khan and Shahrookh Khan on 20.07.2024, who changed the Fastag as well as number plate of the vehicle and have been using it without paying any rent.

Learned counsel further submits that in support of the allegations, the complainant has not given any details of the purchase of vehicle by him, much less the insurance policy or the registration documents, and even the police has not recorded a satisfaction that actually the complainant owned any such vehicle. According to learned counsel, the vehicle has not been recovered so far, therefore, apparently the applicant has been falsely implicated.

At this Stage, learned State Counsel states that during investigation it is found that the subject vehicle has been disposed of in parts/ pieces. However, he prays for time to seek instructions, if, the ownership of the vehicle was verified.

Issue notice the opposite party No. 2 returnable on 09.12.2025 as fresh.

Meanwhile, in the event of arrest of the applicant-Shahrokh Khan alias Mohd. Shahrookh, it is ordered that arresting officer/ investigating officer

shall release him on interim bail subject to his furnishing the requisite bail bonds. The applicant shall join the investigation as and when required, who shall also abide by the conditions enshrined in Section 482 (2) BNSS.
