Allahabad High Court (Court No. 87), order dated November 14, 2025, Anil Kumar-X, J., in APPLICATION U/S 529 BNSS No. - 4288 of 2025 (Smt. Charan Devi v. State of U.P. and Another). Learned counsel reported that the applicant's Section 156(3) Cr.P.C. application had been treated as a complaint case by the trial court; witness statements under Sections 200 and 202 Cr.P.C. were recorded in 2022, but instead of passing orders under Section 203 or 204 the trial court sent a notice to the opposite party to appear for mediation. Before deciding anything, the Bench directed that the current status of the complaint case be sought from the court through the concerned District and Sessions Judge, and required the trial court to explain (i) the circumstances in which it sent the parties to mediation after recording statements under Sections 200 and 202 Cr.P.C., and (ii) why no orders were passed on the complaint despite the statements being on record. Learned counsel for the applicant and learned A.G.A. for the State are present.

Learned counsel for the applicant has submitted that the application filed by the applicant under Section 156(3) Cr.P.C. has been treated as complaint case by the trial court. Statement of witnesses under Sections 200 and 202 Cr.P.C. were recorded in the year 2022. It was further submitted that in place of passing orders on the said complaint, either under Section 203 or 204, the trial court has sent a notice to the opposite party to appear for mediation.

Before passing any order on the application, it will be expedient to seek the current status of the complaint case from the court through concerned District and Sessions Judge. The trial court will also explain the following two things :-

(i) Under which circumstances, the trial court is sending the parties to the mediation after recording of statements under Sections 200 and 202 Cr.P.C.; and

(ii) Why no orders on the said complaint case were passed when statements of complainant and witnesses were on record.
