Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

Learned counsel for the applicant has submitted that the applicants have been arrayed as accused in Case No.438 of 2011 ( Old Case No.1389 of 2007), arising out of Case Crime No.68 of 2007, under Sections 147, 323, 504, 506 IPC, at Police Station Bishrakh, District Gautam Budh Nagar, is pending in the Court of learned Chief Judicial Magistrate, Gautam Budh Nagar and no progress till now has been made in the said case. Learned counsel, therefore, prays that a direction be issued to the court below to decide the said case as expeditiously as as possible.

Considering the submissions made by learned counsel for the applicant, the court below concerned is directed to decide the aforesaid case expeditiously and preferably within a period of six month from the date of production of a certified copy of this order, provided there is no legal impediment.

The application under Section 529 B.N.S.S. is disposed of accordingly.
