Shri Gouri Shanker Singh, learned counsel for the applicant submits that inadvertently and due to typographical error the 'application for interim relief' has been typed before prayer in the application at page No.4, therefore, he may be permitted to delete the same. To which there is no objection by learned A.G.A.

In view of above learned counsel for the applicant is permitted to delete 'application for interim Relief' on memo at page No.4 and write it as "Prayer".

This application has been filed for disposal of the application under Section 133 Cr.P.C./152 Bhartiya Nagrik Suraksha Sanhita, 2023 moved by the applicant.

Submission of learned counsel for the applicant is that the report was submitted by the police on 06.07.2024. Considering the same, the court issued notice on 11.09.2024. Thereafter the respondent no.2 appeared on the date fixed, but thereafter he has not appeared, therefore, the court proceeded exparte by means of order dated 27.05.2025, but till date the same has not been disposed of.

The order dated 27.05.2025 indicates that while proceeding exparte, the court directed to the applicant to adduce evidence and the date was fixed on 27.06.2025. However on query being put to learned counsel for the applicant, he failed to intimate as to whether the evidence has been filed or not and if filed on which date.

In view of above, this court is not inclined to issue any direction

at this stage. Even otherwise the request, if any, for expeditious disposal of case can be made before the concerned court in view of law laid down by the Hon'ble Supreme court and the court concerned may consider the same in accordance with law at appropriate stage.
