1.Heard learned counsel for the applicants and learned A.G.A for the State and perused the record.

This application under Section 529 BNSS has been preferred by the applicants to direct the Special Chief Judicial Magistrate, Kanpur Nagar to permit the appellant to appear through representation for verification of compromise dated 20.8.2024 entered between the parties as the applicants are not in position to appear before the court concerned due to old age disease arising out of Crime No.648 of 2019, under Section 498-A IPC, PS- Naubasta, District- Kanpur Ngar.

Learned counsel for the applicants submits that the applicant no.1 is aged about 82 years and applicant no.2 is aged about 77 years, suffering from several disease and with regard to the same, they have filed medical certificate. He further submits that earlier, the applicant has approached before this Court in Application U/S 482 No.2693 of 2021 and co-ordinate Bench of this Court vide order dated 27.2.2025 has disposed of the same directing the court below to verify the compromise entered between the parties and submits a report to this Court but being old age and suffering from several disease, the applicants could not appear before the court concerned.

Considering the facts of the case but without expressing any opinion on the merits of the applicant's case, this application U/s 529 B.N.S.S. is finally disposed of with a direction to the court below concerned to accept the appearance of applicants through video conferencing and verify their compromise, if any filed before it.
