Sri Satya Prakash Chaturvedi, learned counsel for the applicant and Sri Pushraj Singh, learned brief holder for the State are present.

The present application u/s 528 of B.N.S.S. has been filed with prayer to quash the entire proceedings of Case No.1973 of 2018 (State Vs. Dheerendra @ Dheeru and another), arising out of Case Crime No.1256 of 2017, as well as cognizance/summoning order dated 17.04.2018, by which the learned Magistrate took cognizance under Sections 420, 406, 467, 468, 471 I.P.C., Police Station Kotwali Orai, District Jalaun at Orai pending in the Court of Chief Judicial Magistrate, Jalaun at Orai.

Learned counsel for the applicant fairly admits that as per the allegations of FIR, on several dates the amount has been withdrawn by Grahak Seva Kendra of Bank from the account of the first informant/complainant.

After some arguments, learned counsel for the applicant does not want to press the present application with liberty to file appropriate application/bail application/proceedings before the competent jurisdiction.

In view of above, the application u/s 528 BNSS is dismissed as not pressed with the aforesaid liberty.
