Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

By means of the present application under Section - 528 B.N.S.S., the applicant has sought for a suitable direction to the Chief Judicial Magistrate, Mathura to expedite the proceedings and to decide the Case No. 22867 of 2023 (Kedar Vs. Dharnidhar and Others), under Sections - 302, 506 I.P.C., Police Station - Baldeo, District - Mathura, within time stipulated by this Court, which is pending before the aforesaid court.

It is submitted by learned counsel for the applicant that applicant is complainant of the aforesaid case and after investigation, police have submitted final report. Applicant has filed a protest petition, which was registered as a complaint case and the accused persons were summoned for offence under Section - 302, 506 I.P.C. vide summoning order dated 05.07.2024. It was stated that after summoning order, no progress at all has been made in the case so far and thus, a direction may be issued to the concerned court to decide the aforesaid case within specific time frame.

It is apparent from record that there are no such compelling

reasons, so as to make any direction to the Court concerned to expedite the proceedings of aforesaid case, wherein the accused persons have been summoned vide summoning order dated 05.07.2024. However, needles to state that the Court concerned shall proceed with the matter, as expeditiously as possible in accordance with law and to conclude the committal proceedings at the earliest.

The application under Section 528 B.N.S.S. is disposed of accordingly.
