Heard Sri Sandeep Kumar Chaurasiya, learned counsel for the applicant, learned AGA for the State of U.P. and perused the record.

As per version of the F.I.R. it transpires that the applicant is guarantor in the present case. It has further been contended that out of Rs.11,50,000/- Rs. 10,00000/- has been paid. Since the applicant is not in contact with the opposite party No.2, therefore, he intends to pay the remaining amount.

Issue notice to opposite party No.2 returnable within three weeks.
