Heard Sri Manoj Yadav, learned counsel for the applicant and Sri Vijay Kumar, learned AGA, for the State.

Learned counsel for the applicant submits that applicant was Gram Vikas Adhikari and as per allegation, he and other accused persons misappropriated public fund relating to Sampurna Gramin Rojgar Yojna but merely on the basis of general and omnibus allegation they have been made accused in the present matter.

He further submits that FIR of the present case was lodged in the year 2006 but charge sheet could only be filed in the year 2021, i.e., after about 15 years and cognizance was taken in the year 2022, i.e., after 16 years and, therefore, fundamental right of speedy trial of the applicant has been violated.

He further submits that co-accused Shashi Bhushan Sharma, who was also public servant when approached this Court by way of Application U/S 528 No. 48338 of 2025 then this Court after considering the fact that prima facie it appears to be violation of fundamental right of speedy trial called the counter affidavit explaining the delay in investigation.

He next submits, the instant application may be connected with the above matter filed by co-accused Shashi Bhushan Sharma so as both the matters may be heard simultaneously on 15.12.2025, i.e., on the date fixed.

Learned AGA is having no objection.

In view of the above, connect the instant application with Application U/S 528 BNSS No.48338 of 2025.

List the instant matter along with the connected matter on 15.12.2025 amongst top ten cases in the category of daily cause list.

Considering the fact that with regard to above mentioned accused proceedings have already been stayed, in the interest of justice proceedings of the case shall also remain stayed with regard to the applicant till the next date of listing, in Special Trial No.631 of 2022 arising out of Case Crime No.36 of 2006 (State of U.P. Vs. Satyendra Singh Gangawar and others ), under Sections 409, 420, 467, 468, 471, 477A and 120B/34 IPC and Section 13(2) Prevention of Corruption Act, Police Station Maniyar, District Ballia pending in the court of Additional District and Session Judge/Special Judge (Prevention of Corruption Act), Special Court No.1, Varanasi.
