Heard Mr. Rajesh Kumar Tiwari, the learned counsel for applicant and the learned A.G.A. for State opposite party 1.

Perused the record.

Applicant Junid Khan, who is the first informant, has approached this Court by means of present application under Section 528 B.N.S.S. with the following prayer:-

"It is therefore most respectfully prayed that this Hon'ble Court may be pleased to allow the application and direct the Trial Court to conclude the Special Session Trail No.100 of 2022 (State versus Sarvar and others) under sections 504, 506, 376 IPC and 5/6 POCSO Act, Police StationBuxa, District-Jaunpur arising out of Case Crime no.173 of 2021, Police Station-Buxa, District-Jaunpur, pending before The Additional Session Judge/POCSO Act Ist, Jaunpur, if possible within a period of two month, and/or pass any such other and further order which this Hon'ble Court may deem fit and proper in the circumstances of the case. So that justice may be done."

On the matter being taken up, the learned counsel for applicant fairly submits that there are inherent mistakes in the present application, which cannot be cured by filing a supplementary affidavit or an amendment application, therefore, the present application be dismissed as withdrawn with liberty to file fresh with better particulars and details.

Prayer made by the learned counsel for applicant is bona fide. Same is not opposed by the learned A.G.A. representing State opposite party 1.

Accordingly, present application is dismissed as withdrawn with liberty aforesaid.

Certified copy of the documents appended along with this
