This application has been filed by the applicant with the following prayers:-

" 1- यह िक सम्माननीय न्यायालय से न्यायिहत में सादर प्राथर्ना है िक पिरवाद संख्या558/2023 श्रीमती वषार् गोयल बनाम अिभषेक कुमार गोयल अन्तगर्त धारा 12 घरेलू िहसा सं मिहलाओं का संरक्षण अिधिनयम 2005 थाना गजरौला जनपद अमरोहा के सन्दभर् में माननीय न्यायालय िद्वतीय अपर िसिवल जज जू०डी० जेम अमरोहा द्वारा पािरत आदेश िदनांिकत 19-4-2023 (संलग्नक संख्या 5) पर जारी न्याियक कायर्वाही (परीक्षण/ट्रायल) को इस दािण्डक प्रकीणर् प्राथर्ना पत्र के लम्बवनकाल में स्थिगत िकए जाने का उिचत न्यायोिचत आदेश पािरत िकए जाने की महती कृपा करें।

4- यह िक अन्य भी उिचत / न्यायोिचत आदेश, िनदेर्श जो उक्त दािण्डत प्रकीणर् प्राथर्ना पत्र के साथ संलग्नक शपथ पत्र में विणत तथ्य एवं पिरिस्थितयों को दृिष्टगत रखते हुए उिचत / न्यायोिचत हो वह अनुतोष भी प्राथीर् के पक्ष में पािरत िकये जाने की महती कृपा करें अन्यथा प्राथीर् को अपूणर्नीय क्षित होगी िजसकी भरपाई भिवष्य में होना नामुमिकन है। "

It is submitted by learned counsel for the applicant that an application under Section 340 Cr.P.C. has been preferred before the court concerned. Applicant is the husband and the proceedings under Section 12 of the Domestic Violence Act is being proceeded with against the applicant. Learned counsel for the applicant further submits that application under Section 340 Cr.P.C. may be considered and decided in accordance with law.

In view of the statement made by learned counsel for the applicant, the present application filed under Section 528 BNSS is disposed of with the direction that the application of the applicant under Section 340 Cr.P.C. be considered expeditiously in accordance with law.
