Heard learned counsel for applicant and learned AGA for the State.

The application has been filed for quashing the Non Bailable Warrant dated 17.06.2025 passed by Additional Chief Judicial Magistrate, Court No.10, Azamgarh in Complaint Case No.5955 of 2024, under Section 138 N.I. Act, P.S. Rani Ki Sarai, District Azamgarh.

Learned counsel for applicant submits that by order dated 17.6.2025, non bailable warrant has been issued against applicant for non appearance. At this stage, learned counsel for applicant submits that applicant is ready to appear before the court concerned and participate in the trial court proceedings.

In view of stand taken by learned counsel for applicant, applicant is directed to appear before the court concerned on or before 27.11.2025 and participate in the trial court proceedings. If the applicant appears before the court concerned as directed hereinabove and participate in the trial court proceedings, non bailable warrant order dated 17.06.2025 passed by Additional Chief Judicial Magistrate, Court No.10, Azamgarh in Complaint Case No.5955 of 2024, under Section 138 N.I. Act, shall be kept in abeyance. In default in appearing before the court concerned as directed hereinabove or fails to participate in the trial court proceedings, the trial court would be at liberty to execute non bailable warrant in accordance with law.

With the aforesaid observation/direction, the application under Section 528 BNSS is disposed of.
