Vakalatnama and Short Counter affidavit filed by Sri Vivek Tripathi, on behalf of the opposite no.2, today in Court, is taken on record.

Heard Sri Ramesh Kumar Mishra, learned counsel for the applicants, Sri Vivek Tripathi, learned counsel for the opposite party no.2 and Sri Kamlesh Kumar Tiwari, learned A.G.A. for the State.

The instant application under Section 482 Cr.P.C. has been filed seeking quashing of the charge-sheet dated 02.07.2022 as well as summoning/cognizance dated 09.08.2023 passed in Case No. 1850 of 2023 (State vs. Ramu Singh and Others) arising out of Case Crime No. 59 of 2022 under Sections 498A, 323, 504, 506 I.P.C. and Sections 3/4 of the D.P. Act, P.S.- Mohabbatpur Painsa, District- Kaushambi, pending in the court of Judicial Magistrate, Kaushambi.

Learned counsel of the applicants submits that the applicant no.1 and opposite party no.2 are the husband and wife and there was some discord between them due to which the instant F.I.R. was lodged by opposite party no.2 against all the applicants herein, however, after submission of the charge-sheet the parties have settled their disputes amicably and a compromise has been executed on 15.09.2025 between the parties. A compromise application along with affidavits of both the parties have already been filed before the trial court concerned, according to which

both the parties have settled their disputes amicably and decided to live together as husband and wife. In view of the settlement of the matrimonial dispute, learned counsel for the applicants seeks quashing of the entire proceedings of the instant case on the basis of the aforesaid compromise dated 15.09.2025.

Learned counsel for the opposite party no.2 admits the aforesaid facts of settlement of dispute between the parties and also that they are living together as husband and wife and supports the prayer for quashing of the entire proceedings against applicants herein.

Having regard to the facts and circumstances of the case, the parties are directed to appear before the trial court concerned for verification of compromise within three weeks from today. Upon such appearance of the parties the trial court shall proceed to verify the compromise in accordance with law and send a report to this Court within two weeks thereafter. In the meantime, the parties shall also file certified copy of the compromise as well as the order verifying the compromise by the next date of listing by way of supplementary affidavit.

List this matter on 27.11.2025 in daily cause list, showing the name of Sri Vivek Tripathi as learned counsel for the opposite party no.2
