Sri Amit Kumar Singh has filed vakalatnama on behalf of opposite party no.2 today in Court, which is taken on record.

Heard Sri Balbeer Singh, learned counsel for the applicant, Sri Amit Kumar Singh, learned counsel for opposite party no.2 and Ms. Kirti Singh, learned AGA for the State.

The instant application has been filed seeking quashing of the charge sheet dated 02.06.2022 as well as the summoning order dated 17.10.2022 and the entire proceeding of Criminal Case No;. 10864 of 2022 (State vs. Pappu and others) under Section 498A, 323, 504 IPC and 3/4 D.P.Act, P.S. Etmadudaula, District Agra, pending before the court of Additional Chief Judicial Magistrate, Court No.8, Agra.

Learned counsel for the applicant submits that the instant case is arising out of a matrimonial dispute between the applicant and opposite party no.2 who are husband and wife. During the proceeding of the instant case before the trial court, the parties have settled their dispute amicably and a compromise dated 16.09.2025 was arrived at between the parties, photocopy of which has been placed on record as annexure-5 to the instant application. Learned counsel for the applicant submits that an application under Section 13-B of the Hindu Marriage Act has been filed by the parties before the Family Court, Agra. In view of the aforesaid, the applicant as well as opposite party no.2, both seek quashing of the entire

proceedings against each other. A joint compromise application has already been filed by the trial court concerned by both the parties.

In view of the aforesaid submissions, let the parties file a fresh compromise before the trial court concerned within a period of two months from today. Upon such appearance and presentation of the fresh compromise arrived at between the parties, the trial court shall verify the compromise in presence of the parties and submit a report to this Court within two weeks thereafter.

List this case on 20.01.2026 before the appropriate Bench.

Till the next date of listing, no coercive steps shall be taken against the applicant.

The applicant is also directed to place on record the certified copy of the order verifying the compromise and the certified copy of the compromise arrived at between the parties before the next date of listing.
