Heard learned counsel for the applicants and learned A.G.A. for the State.

This application u/s 528 Bharatiya Nagarik Suraksha Sanhita ( hereinafter referred to as 'BNSS' ) has been filed seeking following relief:-

"It is, therefore, most respectfully prayed that this Hon'ble Court may graciously be pleased to allow this application and direct

the court below to consider the sureties and personal bond in one case and treat the same for all other 14 cases of the

applicants. The case details of the applicants are follows as under:

I- Case crime no. 197 of 2022 under section 380, 457, 411, 413, 414 of 1.P.C. Police Station-Ubhav, District Ballia.

II- Case crime no. 55 of 2022 under section 380, 411, 413, 414 of I.P.C. Police Station-Ubhav, District Ballia.

III- Case crime no. 202 of 2022 under section 457, 380, 411, 413, 414 of 1.P.C. Police Station-Ubhav, District Ballia. IV- Case crime no. 204 of 2022 under section 399, 402 of I.P.C. Police Station-Ubhav, District Ballia. V- Case crime no. 79 of 2022 under section 380, 411, 454 I.P.C. Police Station-Kotwali, District Ballia. VI- Case crime no. 268 of 2022 under section 380, 411 I.P.C. Police Station-Kotwali, District Ballia. VII- Case crime no. 385 of 2022 under section 380, 411 I.P.C. Police Station-Kotwali, District Ballia.

XI- Case crime no. 159 of 2022 under section 380, 457, 511 I.P.C. Police Station-Phefna, District Ballia.

XII- Case Crime no. 184 of 2022 under section 457, 380, 411, 413, 414 P.S. Phefna District Ballia.

And or / pass such other and further order which this Hon'ble Court may deem fit in the circumstances of the case. Otherwise the applicants shall suffer irreparable loss."

It was submitted that applicants have been granted bail in all the aforesaid cases subject to condition of furnishing a personal bond and two sureties of like amount to the satisfaction of the court concerned. The applicants are unable to arrange separate sureties for each of the aforesaid cases and due to that reason they could not come out on bail. All these cases are pending in district court Ballia. It was further submitted that in view of these facts and circumstances, the applicants may be permitted to furnish personal bond and two sureties in Case crime no. 197 of 2022, under Sections 380, 457, 411, 413, 414 I.P.C., Police Station- Ubhav, District Ballia, which may hold good in all the remaining 13 cases against each of the applicants, which have been mentioned above.

Having considered the facts and circumstances of the case, it is directed that applicants shall be allowed to furnish a personal bond and two sureties to the satisfaction of the court concerned in Case Crime No. 197 of 2022, under Sections 380, 457, 411, 413, 414 of I.P.C., Police Station- Ubhav, District Ballia, if they have already been granted bail, and they would submit personal bonds in all the remaining aforesaid 13 cases and the sureties submitted in Case crime no. 197 of 2022 would hold good in all the remaining 13 cases against each of the them, if they have already been granted bail in those cases. The photocopies of the sureties bonds submitted in Case crime no. 197 of 2022 shall be submitted in remaining aforesaid 13 cases against each of the applicants. After submission of bail bonds in Case crime no. 197 of 2022, the applicants would not be required to submit separate sureties bonds in said remaining 13 cases, which have been mentioned above.

The application under Section 528 BNSS is disposed of in above terms.
