At the outset, Learned counsel for the applicants states that the applicant No.1 has died, as such, the proceedings with respect to applicant No.1 stand abated.

Learned counsel for the applicants has raised factual disputes, which cannot be adjudicated upon in proceedings under Section 528 BNSS.

Prima facie from the perusal of the record, it is indicated that there are injuries supporting the allegations under Section 325 IPC, therefore, no interference can be made in proceedings under Section 528 BNSS.

Learned counsel for the applicants then contends that the applicants may be allowed time to appear before the concerned Court and obtain bail/anticipatory bail.

¶14

If the applicants appear before the concerned Court within a period of three weeks and apply for bail/anticipatory bail, as advised, the same shall be considered expeditiously in accordance with law.

With these observations, this application is disposed off .
