Heard learned counsel for the parties.

Present application has been preferred with prayer to quash the charge sheet dated 14.05.2020 and summoning order dated 20.04.2022 passed by learned Judicial Magistrate, Gunnaur, District Sambhal as well as entire proceeding of Case no. 530 of 2022 (State vs. Narendra and others) arising out of Case Crime no. 0058 of 2020 under Section 9/51 of Wildlife Protection Act, 1972, PS- Rajpura, District Sambhal.

For challenging the entire proceedings initiated against the applicants, learned counsel for applicants argued that allegation against applicants if for torturing wolves and tying bells around their neck only. Prosecution has failed to assign any specific role to the applicants, hence the entire proceeding is liable to be quashed.

On earlier occasion, instructions were called from learned AGA with regard to criminal history credited to applicants, if any.

Today when the matter has been taken up, as per the instructions so received by learned AGA, he submitted that no criminal history is pending against the applicants.

From perusal of records, this Court finds that so far as the allegation put forward against the applicants through instant matter is concerned the

same is for committing offence jointly and as such no specific corroborated evidence is available in the records and as such applicants are hereby directed to appear before learned court concerned for cooperating with the learned trial court to expedite the trial through counsel.

The instant application u/s 528 BNSS stands disposed of accordingly.
