Heard Shri Ashok Kumar Upadhyay, learned counsel for the applicant and Shri Alok Mishra, learned A.G.A. for the State.

The present application under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the applicant to quash the order dated 30.5.2025 passed by Additional Sessions Judge, Court No. 4, Ballia in Criminal Revision No. 18 of 2022, whereby the revisional court affirmed the order dated 14.12.2021 passed by Judicial Magistrate, Court No. 2, Ballia in Complaint Case No. 406 of 2014, related to offence punishable under Sections 447, 504, 506, I.P.C., whereby evidence has been closed under Section 246, Cr.P.C.

After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file appropriate application/proceedings before the court of competent jurisdiction.

The instant application is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.

Office shall return the certified copy of the orders to the learned counsel for the applicant, after retaining a xerox of the same.
