Allahabad High Court (Hon'ble Nand Prabha Shukla, J.) — Application under Section 528 B.N.S.S. seeking quashing of the entire proceedings of Complaint Case No. 73564 of 2024 (Vikas Sonkar Vs. Varun Sonkar and another) under Sections 115(2), 352, 351(2), 324(4) of B.N.S., Police Station-Adampur, District Varanasi, together with the impugned summoning order dated 01.04.2025 pending before the Additional Civil Judge (J.D.)/Judicial Magistrate, Court No. 02, Varanasi. Counsel for the applicants stated at the outset that there were chances of settlement through mediation; the Court accordingly referred the matter to the Mediation & Conciliation Centre of the Court with a direction to resolve the dispute after notice to both parties and to submit its report within two months. The matter was directed to be listed on 09.01.2026 in the daily cause list before the appropriate Bench along with the mediation report. Heard learned counsel for the applicants, learned A.G.A. for the State and perused the record.

The present application under Section 528 B.N.S.S. has been filed by the applicants with a prayer to allow the present application and to quash the entire proceedings of Complaint Case No. 73564 of 2024 (Vikas Sonkar Vs. Varun Sonkar and another), under Sections 115(2), 352, 351(2), 324(4) of B.N.S., Police Station-Adampur, District-Varanasi pending in the Court of Additional Civil Judge (J.D.)/Judicial Magistrate, Court No. 02, Varanasi together with impugned summoning order dated 01.04.2025.

At the very outset, learned counsel for the applicants states that there are chances of settlement of dispute through mediation.

Accordingly, the matter is referred to the Mediation & Conciliation Centre of this Court with the direction that same may be tried to be resolved after giving notices to both the parties. The Mediation Centre will submit its report within two months in the matter.
