Sri Manish Pratap Singh, learned Advocate holding brief of Sri R. P. Singh Chandel, learned counsel for the applicant and Sri Sushant Chandra, learned counsel for the E.D. are present.

The instant application under Section 528 B.N.S.S. has been filed by the applicant to set aside the impugned order dated 19.03.2025 passed by Special Judge, (P.C.), C.B.I., Ghaziabad in Special Case No.5 of 2023 (Session Trail No.5 of 2023) (Directorate of Enforcement vs. Shasikant and another), arising out of ECIR No.ECIR/LKZO/03/2019, under Sections 3/4 P.M.L. Act, P.S. E.D., Lucknow, pending in the court of Special Judge, (P.C.), C.B.I., Ghaziabad and with further prayer to stay the further proceedings of aforesaid case.

Learned counsel for the applicant submits that applicant is the accused in the present case and he moved an application before the trial court that although under Section 207 Cr.P.C./230 B.N.S.S., E.D. provided soft and hard copies of the documents but the copies of the documents provided to him were not legible, therefore, E.D. may be directed to provide legible copies to him but by way of the impugned order dated 19.03.2025 trial court dismissed his application.

He further submits that impugned order dated 19.03.2025 is prima-facie illegal, as without legible copies of the case, it is not possible for the applicant to defend him effectively, therefore, impugned order dated 19.03.2025 may be quashed and E.D. may be directed to provide him legible copies of the documents.

At this stage, Sri Sushant Chandra, learned counsel for the E.D. submits that although under Section 207 Cr.P.C./230 B.N.S.S. copies of the documents have already been given to the applicant but E.D. is ready to provide legible copies of the documents to him within two weeks and he is having no objection if the instant application be allowed.

I have heard both the parties and perused the record of the case.

As learned counsel for the E.D. has made a statement before this Court that E.D. is ready to provide required legible copies to the applicant, therefore, it is directed that E.D. shall provide legible copies of the required documents to applicant within two weeks.

Instant application filed by applicant stands disposed off accordingly.
