1- प्राथीर् की ओर से यह प्राथर्ना पत्र अन्तगर्त धारा 528 बी . एन . एस . एस ., वाद संख्या 3582 वषर् 2024 ( राज्य प्रित जीशान एवं अन्य ), मु०अ०सं० 425 वषर् 2021 अन्तगर्त धारा 420 भा०दं०सं० एवं धारा 66( डी ) आई . टी . एक्ट , थाना छाता , में प्रेिषत आरोप पत्र िदनाँक 10.09.2023 एवं प्रसंज्ञान आदेश िदनाँिकत 19.07.2024, जो िवद्वान िसिवल जज ( जू . िड .)/ न्याियक मिजस्ट्रेट , छाता मथुरा के समक्ष लिम्बत है , की सम्पूणर् कायर्वाही को िनरस्त करने हेतु योिजत िकया गया है।

2- प्राथीर् की ओर से िवद्वान अिधवक्ता एवं राज्य की ओर से िवद्वान अपर शासकीय अिधवक्ता को िवस्तारपूवर्क सुना एवं पत्रावली का अवलोकन िकया।

3- प्राथीर् के िवद्वान अिधवक्ता द्वारा तकर् प्रस्तुत िकया गया िक प्राथीर् िनदोर्ष है , उसे इस प्रकरण में झूंठा फंसाया गया है। प्राथीर् की प्रश्नगत वाद में संिलप्तता मात्र खाताधारक के आधार पर उपरोक्त अपराध संख्या में सुिनिश्चत की गयी है। प्राथीर् के िवद्वान अिधवक्ता द्वारा यह तथ्य प्रकाश में लाया गया है िक प्राथीर् की जमानत पूवर् में ही िदनांक 01.08.2025 को स्वीकृत की जा चुकी है। उनके द्वारा यह भी तकर् प्रस्तुत िकया गया िक िववेचक ने गलत तथ्यों के आधार पर प्राथीर् के िवरूद्ध आरोप पत्र सम्बिन्धत न्यायालय में प्रस्तुत िकया है। प्राथी के िवरूद्ध कोई अपराध नहीं बनता है। िवद्वान अवर न्यायालय ने प्रसंज्ञान लेते समय न्याियक मिस्तष्क का प्रयोग नहीं िकया है। ऐसी दशा में प्रश्नगत मामले की सम्पूणर् कायर्वाही िनरस्त िकये जाने योग्य है।

4- इसके पूवर् आदेश िदनांक 11.09.2025 को िवद्वान अपर शासकीय अिधवक्ता द्वारा उपरोक्त अपराध संख्या के संदभर् में सम्पूणर् आख्या / िनदेर्श प्राप्त करने का अनुरोध िकया गया था , िजसके अनुपालन में आज िवद्वान अपर शासकीय अिधवक्ता द्वारा तकर् प्रस्तुत िकया गया िक प्राथीर् की संिलप्तता खाता संख्या के आधार पर आरोप पत्र के माध्यम से सुिनिश्चत की गयी है , िजस खाता संख्या में कई बार धनरािश का संव्यवहार हुआ है। उनके द्वारा यह भी तकर् प्रस्तुत

िकया गया िक िवद्वान अवर न्यायालय द्वारा पािरत प्रश्नगत प्रसंज्ञान आदेश िविधसंगत है , िजसमें हस्तक्षेप का कोई आधार नहीं है।

5- उपरोक्त विणत िनदेर्श / अनुदेश के आधार पर सम्बिन्धत अवर न्यायालय द्वारा संज्ञान िलये जाने का पयार्प्त आधार िवद्यमान है। अतः इस स्तर पर इस न्यायालय द्वारा िकसी भी प्रकार का उपरोक्त मु०अ०सं० 425 वषर् 2021 अन्तगर्त धारा 420 भा०दं०सं० एवं धारा 66( डी ) आई . टी . एक्ट , थाना छाता , िजला मथुरा में िकसी भी प्रकार का हस्तक्षेप का कोई आधार नहीं है।

6- तद्नुसार प्रस्तुत प्राथर्ना पत्र अन्तगर्त धारा 528 बी . एन . एस . एस . बलहीन है और िनरस्त िकये जाने योग्य है।

7- तद्नुसार वतर्मान प्राथर्ना पत्र िनरस्त िकया जाता है।

8- प्राथीर् के पास वतर्मान मामले से सम्बिन्धत अऩ्य सभी िविधक उपचार सक्षम न्यायालय के समक्ष उपलब्ध रहेंगे।
