The matrimonial dispute between applicant No.1 and opposite party No.2 was settled amicably by written compromise dated 24.10.2024 (parties to live separately), verified by the court below on 10.4.2025 pursuant to this Court's order dated 19.3.2025 in Application u/s 528 No. 7802 of 2025. Relying on Gian Singh v. State of Punjab (2012) 10 SCC 303, Narinder Singh v. State of Punjab (2014) 6 SCC 477, State of M.P. v. Laxmi Narayan (2019) 5 SCC 688 and State of M.P. v. Dhruv Gurjar AIR 2017 SC 1106, the Court held that mere mention of a serious-offence section does not preclude quashing where no such offence is made out on the record, that no heinous offence of mental depravity was made out, and that continuation after a verified compromise would be a travesty of justice.
