Heard Mr. Manu Mishra Advocate alongwith Mr. Asheesh Mani Tripathi, the learned counsel for applicant and the learned A.G.A. for State-opposite party-1

Perused the record.

Applicant-Rewati Raman Sharma Alias Raman Sharma, who was named accused but subsequently exculpated in the charge sheet submitted by the Investigating Officer was subsequently summoned by court below in exercise of jurisdiction under Section 319 Cr.P.C.. Thereafter, court below vide order dated 22.07.2024 has framed charges against accused/applicant in exercise of jurisdiction under Section 228 Cr.P.C.

Thus feeling aggrieved by the order dated 22.07.2024 applicant has now approached this court by means of present application under Section 528 BNSS.

At the very outset, the learned A.G.A. submits that against framing of charge order, the D.G.C. (Criminal) himself filed an application dated 16.07.2024 before court below with the prayer that charge under Section 364 I.P.C. has been wrongly framed against applicant.

When confronted with above, the learned counsel for applicant

submits that aforementioned application filed by D.G.C. (Criminal) before court below is till pending.

Having heard the learned counsel for applicant, the learned A.G.A. for State and upon perusal of record this court finds that in view of the pendency of the application dated 16.07.2024 referred to above, no useful purpose shall be served in keeping this application pending.

Accordingly this application is disposed of finally with a direction to court concerned to decide the aforementioned application dated 16.07.2024 filed by D.G.C. (Criminal) within a period of one months from the date of presentation of a certified copy of this order.
