Sri S.P. Tiwari,learned AGA raised a preliminary objection that this petition is not maintainable because the deponent has failed to indicate his relation with the detenue as he has shown that he is Live In-Relation/Partner/Husband but all the three cannot be simultaneously. He further submits that as per instructions, the detenue has not married to the deponent, therefore to show himself as husband is misleading.
Learned counsel for the petitioner could not dispute the aforesaid submission at this stage and submits that the petition may be dismissed as not pressed with liberty to file fresh. To which there is no objection by learned AGA.
In view of above, the petition is dismissed as not pressed with liberty as aforesaid.
