Heard Shri Ratnesh Trivedi, learned counsel for the appellant.

At the very outset, learned counsel for the appellant has submitted that the present appeal suffers from some incurable defects in the memo of the appeal. He prayed for the withdrawal of the appeal with liberty to the appellant to file afresh with proper particulars and pleadings.

On the request of learned counsel for the appellant, he is permitted to withdraw the present appeal.

Accordingly, the present appeal is dismissed as withdrawn with the aforesaid liberty.

Learned counsel for the appellant further submits that the statutory amount of Rs. 25,000/- has been deposited in the Treasury vide Tender No.197 (Chapter XXXVI Rule 2) in compliance of Section 173 of Motor Vehicles Act and the appellant may be permitted to withdraw the same.

As the present appeal has been dismissed as withdrawn, the learned counsel for the appellant is at liberty to withdraw the aforesaid amount.
