Under challenge is the award passed by the learned Motor Accident Claims Tribunal, Faizabad (Ayodhya) (hereinafter referred to as "Tribunal") in Claim Petition No. 408 of 2018 Inre; Shashi Bala and Ors Vs. Bharti Axa General Insurance Co. Ltd and Ors whereby the learned tribunal has awarded a sum of Rs. 81,38,838/- in favour of the claimants.

6. The sheet anchor of the argument of the learned counsel for the appellant is that the vehicle involved in the instant claim petition as emerges from a perusal of the details of respondent no. 4 who is said to be the driver of the offending

vehicle, is Vehicle No. UP32 S 4525 which incidentally is the same vehicle which is involved, as per the information available at this stage, in two other claim petitions which are pending at Faizabad namely Claim Petition No. 134 of 2014 Inre; Smt, Pooja and Ors Vs. IFCO Tokeyo General Insurance in which the number of the Vehicle has been indicated as UP32 S 4525 (page 53 of the instant appeal) as well as in another claim petition which is pending at Barabanki which has been filed in the year 2021 in Claim Petition No. 240 of 2021 Inre; Smt. Poonam Tiwari and Ors Vs. Future Generally India Insurance Co. Ltd in which again, as per the parties impleaded as respondent no. 3, the vehicle number has been indicated as UP32 S 4525 (page 61 of the appeal).

7. Argument is that it is apparent that the same vehicle is being used in repeated claim petitions which have been filed against different insurance companies in order to claim an amount from the claims tribunal which raises a suspicion over the entire episode.

Considering the aforesaid and more particularly when prima facie from a perusal of the three claim petitions which have been brought to the notice of this Court it emerges that the same vehicle is involved in all the three accidents, as such, let a copy of this appeal be served upon the learned Chief Standing counsel during the course of the day who shall seek instructions from the Principal Secretary (Home) pertaining to the alleged serious nature of the offence and as to whether the said vehicle has been used in any other claim petitions which are being filed or pending through out the State of U.P.

9. Let such instructions be obtained by the next date of listing.

The affidavit has been filed by the Superintendent of Police concerned. In the affidavit, it has been clarifed that the vehicle has been involved in various accident and the same vehicle is being used by repeated claims petitions against different insurance companies.
