Learned AGA has filed an affidavit on behalf Secretary, Home Department, Government of Uttar Pradesh, Lucknow, today in Court, which is taken on record.

Heard Shri Manish Goyal, learned Additional Advocate General, assisted by Shri Pradeep Kumar Tripathi, learned AGA for the State and perused the material available on record.

Learned AAG has pointed out that in respect of similar controversy, an Application U/s 482 CrPC No. 22859 of 2024 (Birendra Singh Vs. State of U.P. and Another) was filed before this Court. Pursuant to which, an order dated 20.08.2024 was passed by this Court.

In compliance of the said order dated 20.08.2024, Government of Uttar Pradesh had issued a Government Order dated 12.11.2024 and constituted a three members Committee, consisting of Additional Director General of Police (Prosecution), Additional Director General of Police (Technical Services) and Additional Director General of Police (Crime), Uttar Pradesh, who prepared a comprehensive guidelines to take further action.

Pursuant thereto, after due deliberations of the said Committee, Director General of Police, Uttar Pradesh had issued a Circular dated 17.11.2024 containing suggestions of the Committee and further directing the Police Authorities to comply with the Circular so that seized vehicles may be released as early as possible.

Learned AAG has further submitted that as per the direction of this Court with regard to creation of Single Window Portal, proceedings have also been initiated by the

Home Department, Lucknow through a Letter No. 4522/6Po-9-2024-754401, dated 18.11.2024, wherein Police Technical Services Headquarters, Uttar Pradesh has been designated as Nodal Department.

It has further been decided that in each District, one Gazetted Police Officer should be nominated as the Nodal Officer to resolve vehicle related queries of the general public through the said Single Window Portal. The State Government has also directed the concerned authorities to provide proper progress report/information weekly to the Home Department, Lucknow.

Learned AAG has further submitted that pursuant to the said directions, weekly report is being submitted to the Home Department, Lucknow, so as to give effect to the orders passed by this Court.

Learned AAG prays for and is granted three weeks' time to file weekly report submitted to the Home Department in compliance of the steps taken by the concerned Police Department.

List this case on 19.05.2025 before the appropriate Bench.

It is made clear that concerned Police Department shall ensure that such guidelines framed by the Director General of Police, Uttar Pradesh are strictly complied with, the progress report of which shall also be submitted by filing an affidavit by the next date fixed.
