Re: Application for Condonation of Delay

Heard Shri Angrej Nath Shukla, learned counsel for the revisionist, learned A.G.A. for the State and perused the material brought on record.

Considering the averments made in the affidavit filed in support of application, under consideration, this Court is of the view that the application is liable to be allowed.

Accordingly, the application is allowed. The delay in filing the revision is condoned.

Order on Revision

By means of the present revision, the revisionist has challenged the order dated 11.02.2025 passed by Additional Chief Judicial Magistrate, VII, Court No.31, Lucknow in Misc. Case No.113283 of 2024 (Sujeet Pandey Vs. Shivratan Tiwari & others) .

Vide order dated 11.02.2025, under challenge, the Magistrate rejected the application of the revisionist preferred under Section 173(4) B.N.S.S. akin to Section 156 (3) Cr.P.C. (now repealed). The said order is extracted hereinunder.

कडे समय ककी दकश्त नहहीं जमन ककी उसजी कनरण ममनडे कनर छजीन लजी हहै। पनरर्थी नडे कहन दक आप अपनजी आईडजी ददिखनइयडे और मम हर मनह दकश्त जमन करतन ह ह मम अपनन बमक स्टडेटममट ददिखन सकतन हहनां और मम अननवश्यक पहैसडे नहहीं दिडे सकतन ह ह इतनन ससुनतडे हजी उन लकोरगों नडे पनरर्थी कको ढकडेल ददियन व भदजी - भदजी रनजलयननां दिडेकर पनरजी कको मनरनडे दिकौडडे। पनरर्थी दनरन उक्ति कडे बनबत रननडे पर सपूचनन दिजी रयजी दकतसु रननडे दनरन ककोई भजी कनयरवनहजी नहहीं करजी रयजी।

सनांबनांजधत रननडे ककी आख्यनन स ुनर पस्तसुत पनररननपत्र कडे सनांबनांध मम रननन हनजन पर ककोई भजी अदभयकोर पनांजजीकशत नहहीं हहै।

पनररननपत्र पर ससुनन तरन सनांलग्न पपत्रगों कन अवलकोकन दकयन। पस्तसुत पकरण मम पनरनांदभक जननांच आख्यन आहहत ककी रयजी जको दक सनांलग्न पत्रनवलजी हहै। पनरनांदभक जनच आख्यनन स ुनर ससुजजीत पननांडडेय दनरन रनडजी ननांबर UP32FX5142 कको महमदन फनइनमस कनांपनजी सडे फनइनडेस करनयजी रयजी दकनांतसु ससुजजीत पननांडडेय दनरन उक्ति रनडजी ककी दकस्त न जमन दकयडे जननडे कडे कनरण कनांपनजी एजडेट दनरन ररकवरजी कडे रूप मम उक्ति रनडजी कको अपनडे कब्जडे मम लडे जलयन। आवडेदिक दनरन लरनयडे रयडे अन्य आरकोप लपूट व मनरपजीट कडे सनांबनांध मम ककोई भजी सनक्ष्य न हजी उपलब्ध करनयडे रयडे तरन न हजी घटननस्रल पर ककोई सनक्ष्य उपलब्ध हहै। पस्तसुत पकरण कडे अवलकोकन सडे पकट हको रहन हहै दक मनमलन सरफडेशजी अजधदनयम सडे सनांबनांजधत हहै। ऐसन पकट हको रहन हहै दक पनरर्थी दनरन दवपकजी पर दिबनव बनननडे कडे आशय सडे यह पनररननपत्र दिनजखल दकयन जननन पकट हको रहन हहै। पनरर्थी दनरन अपनडे पनररननपत्र मडे जननबपूझकर बढन चढनकर करन दकयडे रयडे हम। उपरकोक्ति वदणरत करनगों सडे परमदृष्टयन सनांजडेय अपरनध कनररत हकोनन पररलदकत नहहीं हको रहन हहै। अतएव पसुजलस दनरन दववडेचनन करनयन जननन न्यनयकोदचत तरन न्यनयसनांरत नहहीं हहै। तदिन स ुनर पनररनन पत्र 173 (4) बजी. एन. एस.एस दनरस्त दकयडे जननडे यकोग्य हहै।

Considered the order dated 11.02.2025, under challenge, quoted above, as also the statement of account annexed at page nos.19 to 26 of the paper book as also the application of the revisionist annexed as Annexure No.1 (from page 7 to 11 of the paper book) and other documentary evidence on record.

Also considered the various pronouncements viz. (i) Sukhwasi Vs. State of U.P., reported in 2007 (59) ACC 739 (All); (ii) Lalita Kumari Vs. State of U.P., reported in (2014) 2 SCC 1; (iii) Priyanka Srivastava Vs. State of U.P., reported in (2015) 6 SCC 287; (iv) Ramdev Food Products Private Limited (supra); (v) Vishwanath Vs. State of U.P. and 4 Ors, reported in (2020) ILR 2 All 889 , (vi) Kailash Vijayvargiya vs Rajlakshmi Chaudhuri, reported in (2023) SCC OnLine SC 569 and (vii) XYZ Vs. State of M.P. & others , reported in 2023 (1) JIC 538 (SC) , according to which the compliant can be filed if evidence is not to be collected.

On being confronted, after taking note of the aforesaid, learned counsel for the revisionist submits that this revision may be dismissed with liberty to the revisionist to file a complaint case.

Learned A.G.A. has no objection to the prayer made by learned counsel for the revisionist.

Accordingly, the revision is dismissed with the aforesaid liberty.
