Heard Sri Sheikh Mohammad Ali, learned Counsel for the revisionist and Sri S.P.Tiwari, learned A.G.A. for the State.

The present revision has been filed for the following main relief:-

" Wherefore it is most respectfully prayed that this Hon'ble Court may kindly be pleased to set aside the impugned order dated 02.06.2025 passed by Additional Civil Judge (S.D.)/ACJM Court No.2, Bahraich in Case No.1437/2018, Radhey Shyam Gupta Versus Khairul Nisha, U/S 138 N.I. Act, relating to P.S. Hardi, District Bahraich and discharge the revisionist from the offence under section 138 NI Act and allow the revision, in the interest of justice."

By means of this revision the revisionist-Khairul Nisha, has impeached the order dated 02.06.2025 passed by Additional Civil Judge (Senior Division)/ACJM Court no.2, District-Bahraich, (in short 'Magistrate') in Case No.1437/2018 (Radhey Shyam Gupta Versus Khairul Nisha), under Section 138 Negotiable Instructions Act 1881 (in short 'Act of 1881). Operative portion of order dated 02.06.2025, whereby the application filed by the revisionist in terms of Section 245 Cr.P.C. seeking discharge has been rejected, reads as under:-

"ममेरमे दद्वारद्वा पतद् व ालली कद्वा अवललोकन ककयद्वा गयद्वा पतद् व ालली कमे अवललोकन समे कवकदित हहै कक प्रस्त त ु प्रकरण मम अकभियतुकद्वा कलो न्यद्वायद्वालय दद्वारद्वा अन्तगरत धद्वारद्वा 138 N.I. Act तलब ककयद्वा गयद्वा हहै अकभियतुकद्वा दद्वारद्वा अपनमे उन्मलोचन प्रद्वाररनद्वा पत मम मतुख्य रुप समे यह आधद्वार ललयद्वा गयद्वा हहै कक पररवद्वादिली एववं प्रद्वालररनली कमे अच्छमे सवंबवंध रमे पररवद्वादिली रद्वाधमेश्यद्वाम उनकमे प त बबृजमेश व भितलीजमे दिमेवलीप्रसद्वादि दद्वारद्वा एक बहैनद्वामद्वा 14 लद्वाख मम ककयद्वा गयद्वा लजसममे समे 7 लद्वाख रूपयमे पररवद्वादिली कलो नकदि कदियमे गयमे एववं तलीन चमेक कदियमे गयमे पररवद्वादिली कलो शमेष 7 लद्वाख रूपयमे कद्वा भितुगतद्वान मद्वात दिलो चमेक कमे मद्वाध्यम समे कर कदियद्वा गयद्वा एववं तलीसरद्वा चमेक सवं० 995503 ललौटद्वानमे कमे ललए कनवमेदिन ककयद्वा गयद्वा परवंततु पररवद्वादिली दद्वारद्वा चमेक वद्वापस नहहीं ककयद्वा गयद्वा जबकक पररवद्वादिली कद्वा करन हहै कक पररवद्वादिली कलो कलोई नकदि प्रद्वाप्त नहहीं हहआ हहै चमेक सवं० 995501 व 995502 समे मद्वात 7 लद्वाख रुपए प्रद्वाप्त हहए हह एववं शमेष 7 लद्वाख रूपयमे चमेक सवंख्यद्वा 995503 समे भितुगतद्वान ककयद्वा जद्वानद्वा रद्वा परवंततु उक चमेक अनद्वादिररत हलो गयद्वा यहद् व ा न्यद्वायद्वालय कद्वा मत हहै कक प्रश्नगत चमेक अकभियतुकद्वा दद्वारद्वा ककसली कवलधक ऋण ककी अदिद्वायगली मम पररवद्वादिली कलो जद्वारली ककयद्वा गयद्वा रद्वा यद्वा नहहीं यह सद्वाक्ष्य कद्वा प्रश्न हहै लजसकद्वा कनधद्वा र ण सद्वाक्ष्य आनमे कमे उपरद् व ात हली ककयद्वा जद्वा सकतद्वा हहै।

जहद् व ा तक कवपकली कद्वा दिदसरद्वा आधद्वार ककी पररवद्वादिली दद्वारद्वा पररवद्वादि पत मम ककए गए अपनमे करननों कमे समररन मम सद्वाकली शमेखर, गलोवधरन, लद्वाल शतुक्लद्वा, रजनलीश व श्रवण लजनकमे समक घटनद्वा घकटत हलोनमे कद्वा करन ककयद्वा गयद्वा हहै कलो परलीककत नहहीं करद्वायद्वा गयद्वा हहै हहै तलो इस कबवंदितु पर न्यद्वायद्वालय कद्वा मत हहै कक न्यद्वायद्वालय दद्वारद्वा दिद्वालखल समस्त दिस्तद् व ामेजली सद्वाक्ष्य एववं पररवद्वादि पत कमे करननों कमे आधद्वार पर प् र म दृष्टयद्वा मद्वामलद्वा पद्वातमे हहए अकभियतुकद्वा कलो तलब ककयद्वा गयद्वा हहै चद्वाजर कमे स्तर पर न्यद्वायद्वालय कलो मद्वात पररवद्वादि पत एववं उसकमे सद्वार दिद्वालखल समस्त पतनों कमे आधद्वार प् र म दृष्टयद्वा मद्वामलद्वा दिमेखनद्वा हलोतद्वा हहै इस स्तर पर न्यद्वायद्वालय कलो सद्वाक्ष्य कद्वा कवश्लमेषण नहहीं करनद्वा हलोतद्वा हहै और नद्वा हली इस स्तर पर ककसली पककद्वार कलो सद्वाक्ष्य दिद्वालखल करनमे ककी अनतुमकत दिमेनद्वा न्यद्वायलोकचत हहै।

अततः उपरलोक तथ्य एववं पररसस्रकतयनों कमे प्रकद्वाश मम प्रद्वाररनद्वा पत अवंतगरत धद्वारद्वा 245 कनरस्त ककए जद्वानमे यलोग्य हहै।"

It is not disputed that three cheques i.e. cheque no.(s) 995501, 995502 and 995503, are of bank account of revisionist and further it is also not in dispute that all cheques were drawn by the revisionist.

The cheque no. 995503 drawn by the revisionist in favour of opposite party no.2, was bounced and therefore, the opposite party no.2 filed a complaint in terms of Section 138 of the Act of 1881.

It is also not in dispute that summoning order dated 04.01.2019 passed by the Magistrate and order dated 03.02.2021 passed by the revisional court in the revision challenging the order dated 04.01.2019 passed by Magistrate were challenged in Application U/S 482/378/407 No. 1553 of 2021 (Khairulnisha Versus State of U.P. and another), by the present revisionist namely Khairulnisha, was disposed of finally by this Court vide its order dated 22.03.2021, after observing as under:-

"After hearing learned counsel for the parties and perusal of materials available on record, it is found that there is no illegality, irregularity or in-exercise of the jurisdiction vested to learned court below in passing the order. The course of moving discharge application is left open by the accused-applicant."

Taking note of aforesaid as also undisputed facts as also the observations made by the Hon'ble Apex Court in the case of Adalat Prasad Versus Rooplal Jindal and Others, reported in 2004 (7) SCC 338, Expeditious Trial of Cases Under Section 138 of NI Act, 1881 , In re, (2021) 16 SCC 116 and Jai Prakash Goyal v. State of U.P. reported in 2024 SCC OnLine All 777, this Court finds no force in the present revision.

Accordingly, the present revision is also dismissed.
