Heard Sri Krishna Kant Dubey, learned counsel for the revisionist and the learned A.G.A. for the State. Perused the record.

Under challenge is the impugned judgment and order dated 10.9.2025 passed by the learned Additional Sessions Judge, Court No. 1, Ghaziabad, under Section 311 Cr.P.C., in Sessions Trial No. 653 of 2023 (State Vs. Kishan and others), arising out of case crime no. 302 of 2023, under Sections 498-A, 304-B IPC and Section 3/4 Dowry Prohibition Act, Police Station Khoda, Ghaziabad.

Learned counsel for the revisionist has submitted that entire case of the prosecution is based on an application dated 16.5.2023 which was filed by the complainant before the Station House Officer of police station Khoda, District Ghaziabad.

Learned A.G.A. has contended that the statement of complainantHarishankar had been recorded before the trial court on 21.12.2023 and the cross-examination was completed on 9.1.2024. The statement of the prosecution witnesses have already been recorded. The statement under Section 313 Cr.P.C. had been recorded. The evidences were recorded in the presence of accused.
