Criminal Revision No. 457 of 2025, High Court of Judicature at Allahabad, Lucknow Bench (Court No. 12), Hon'ble Rajnish Kumar, J., Order dated 11.7.2025: With both parties present in person pursuant to the order dated 28.4.2025, and it being recorded that the revisionist had deposited Rs. 1,25,000/- before the trial court on 9.5.2025 and that respondent no.2 (present in person) and the revisionist were both agreeable to mediation, the Court referred the dispute to the Mediation and Conciliation Centre of the Court, Lucknow, fixing appearance of the parties on 15.7.2025. The revisionist undertook to pay Rs. 20,000/- by demand draft to respondent no.2 at the Centre on that date towards her attending the mediation proceedings, it being noted that apart from the said deposit nothing had been paid since 2022. In deference to the order dated 28.4.2025 revisionist and respondent no. 2 are present in person.

Learned counsel for the revisionist submits that the revisionist has deposited Rs. 1,25,000/- before the trial court on 9.5.2025.

Shri Ajay Sharma, learned counsel for respondent no.2 fairly submits that the revisionist had deposited the aforesaid amount.

Respondent no.2, who is present in person, on query being put submits that she is ready for mediation for settlement of the dispute. The revisionist, who is also present in person also submits that he is also ready for mediation. However, learned counsel for the respondent no.2 submits that except the aforesaid amount of Rs. 1,25,000/-, nothing has been paid by the revisionist to the respondent no.2 since 2022 and she has no other means, therefore, at least some amount should be paid by the revisionist for attending the mediation proceedings.

Learned counsel for the revisionist, on instruction from the revisionist, fairly submits that the revisionist shall pay Rs. 20,000/-for attending the mediation proceedings, on the first date fixed, in the shape of demand draft. However, he submits that the revisionist after the next week may not be able to appear before the mediation proceedings as he is working in CRPF and he may not get leave for next about one month, therefore dates may be fixed by the Mediation Centre accordingly.

In view of above, the matter is referred to Mediation and Conciliation Centre of this Court, Lucknow, where the parties shall appear on 15.7.2025. The revisionist shall give a demand draft of Rs. 20,000/- in the name of respondent no.2 to her before the Mediation and Conciliation Centre on 15.07.2025.

Learned Mediator shall make earnest endeavor to get the matter settled and he shall also consider the request of the revisionist regarding fixing of dates.

List in the first week of October, 2025.

Interim order granted earlier shall continue till the next date of listing.
