Heard learned counsel for revisionist as well as learned A.G.A. for the State.

By means of present criminal revision, the revisionist has assailed the impugned order dated 19.02.2025 passed by the Chief Judicial magistrate, Hardoi, in Crl. Misc. Case No. 4348/2024, Under Section 173(4) BNSS (Manoj Kumar Vs. Sipahi Bheem Prakash Maurya & others) rejecting the complaint prayed by the revisionist.

It has been submitted that the statements under Section 200 and 202 Cr.P.C. clearly make out a cogent offence and the trial court has misdirected itself by rejecting the said complaint.

Learned A.G.A. on the other hand has submitted that revisionist has an equally efficacious remedy of filing a revision under Section 397 Cr.P.C. / 442 B.N.S.S. against the impugned order.

Learned counsel for revisionist at this stage does not oppose the said objection and submits that he may be permitted to withdraw the present revision with a liberty to file appropriate revision.

Learned A.G.A. has no objection to the said request.

Accordingly, present criminal revision is dismissed as not pressed. However, it is provided that in case the revision is preferred within next two weeks, the revisional court shall proceed to consider and decide the same expeditiously in accordance with law.
