Learned counsel for the revisionist submits that the impugned criminal proceeding is an outcome of matrimonial dispute and the revisionist wants to settle the same through mediation, therefore, he prays that the matter may be referred to the Mediation & Conciliation Centre of this Court. To show the bona fide, learned counsel for the revisionist submits that revisionist-husband is ready and willing to place before this Court a demand draft of Rs.40,000/- in favour of opposite party no.2-wife on the next date.

List this case on 18.02.2025.

On the next date of listing, demand draft of Rs.40,000/- in favour of wife-opposite party no.2 shall be placed before this Court.

Meanwhile, the revisionist shall continue to pay the maintenance amount as directed by the learned Family Court."

Upon due consideration of the facts, as indicated, and also the recitals of the

order dated 28.01.2025, in issue, this Court finds that modification to the extent of issuing notice to the opposite party No. 2 and fixing date is required in the order 28.01.2025. Accordingly, the order 28.01.2025 shall be re-read as under:-

"Heard learned counsel for revisionist and learned A.G.A. for the State.

The instant criminal revision has been filed seeking quashing of the order dated 11.10.2024 passed by learned Second Additional Principal Judge, Family Court, Hardoi in Case No.3400423/2017.

Learned counsel for the revisionist submits that the impugned criminal proceeding is an outcome of matrimonial dispute and the revisionist wants to settle the same through mediation, therefore, he prays that the matter may be referred to the Mediation & Conciliation Centre of this Court. Issue notice to the opposite party no.2, returnable at an early date. Steps in this regard be taken within seven working days.

Let opposite party no.2 be also informed by the SHO concerned regarding the date fixed in the case and he shall also ensure her presence before this Court on the next date fixed.

On the next date fixed, the revisionist/Ajay Kumar shall also appear before this court.

Learned AGA is directed to communicate this order to the SHO concerned forthwith for ensuring compliance.

On the next date of listing, demand draft of Rs.40,000/- in favour of wife-opposite party no.2 shall be placed before this Court.

Meanwhile, the revisionist shall continue to pay the maintenance amount as directed by the learned Family Court."

The order dated 28.01.2025 stands modified accordingly in above terms. The application under consideration is allowed .
