Allahabad High Court (Manjive Shukla, J.), Criminal Revision No. 1129 of 2025, Order dated 11.7.2025 — Revisionists Surendra Singh and another, in custody since 21.02.2025, challenged (i) the judgment/order dated 15.4.2023 of the Civil Judge (J.D.)/F.T.C./Judicial Magistrate (Crime against Women), Etawah in Case No. 156 of 2015 (State Vs. Surendra Singh and others) convicting them under Sections 420, 467, 468, 471 I.P.C. with three years' simple imprisonment, and (ii) the judgment/order dated 21.2.2025 of the Additional Sessions Judge/Fast Track Court No.1, Etawah in Criminal Appeal No.50 of 2033 dismissing their appeal and affirming the conviction and sentence. Heard learned counsel appearing for the revisionists and learned Additional Government Advocate appearing for the State.

The instant criminal revision has been filed challenging therein, the judgment and order dated 15.4.2023 passed by the learned Civil Judge (J.D.)/F.T.C./Judicial Magistrate (Crime against Women), Etawah in Case No. 156 of 2015 (State Vs. Surendra Singh and others) whereby, the revisionist had been convicted under Sections 420, 467, 468, 471 I.P.C. and had been sentenced for simple imprisonment of three years.

The revisionists have also challenged the judgment and order dated 21.2.2025 passed by the learned Additional Sessions Judge/Fast Track Court No.1, Etawah in Criminal Appeal No.50 of 2033 (Surendra Singh and another Vs. State of U.P.) whereby, the appeal filed by the revisionist had been dismissed and the order of conviction and sentence dated 15.4.2023 had been affirmed.

Learned counsel appearing for the revisionists has argued that no case is made out against the revisionists and they have been convicted for the crime in question without there being any evidence against them.

Learned counsel appearing for the revisionists has further argued that the revisionists are in jail since 21.02.2025 and the sentence awarded against them is three years simple imprisonment therefore, they may be released on bail during pendency of this revision.

I have considered the arguments advanced by the learned counsel appearing for the revisionists and prima facie, I find this revision worth consideration.
