Heard learned counsel for the petitioner; Sri Mithlesh Kumar Gautam, Advocate, holding brief of Sri A.K. Rajak, learned counsel for respondent no.3, learned AGA for State-respondents and perused the material on record.
This writ petition has been filed praying for quashing the F.I.R. dated 22.6.2023 giving rise to Case Crime No. 93 of 2023, under Section 306 I.P.C., Police Station- Karimuddinpur, District- Ghazipur.
Learned counsel for respondent no.3 has pointed out that earlier petitioner has filed Criminal Misc. Anticipatory Bail Application No.12389 of 2024 wherein he prayed that he may be permitted to withdraw the application and seek regular bail before the trial court. Now he has filed the aforesaid writ petition challenging the FIR.
In view of the above, no relief can be granted to the petitioner.
This writ petition is dismissed.
