Heard Sri Som Veer, learned counsel for the petitioner and Sri Hari Pratap, learned A.G.A. for the State.

The instant writ petition has been filed by the petitioner seeking quashing of the order dated 25.11.2024 passed by the respondent no. 2-Commissioner, Agra Division, Agra in Appeal No. C202401000002380 of 2024 under Section 6 of the U.P. Control of Goondas Act, 1970 whereby the application for stay of the impugned order before the appellate forum has been rejected.

On 7.10.2024 an order was passed by the Additional District Magistrate, Mathura for externment of the petitioner for six months from the District. Against the said order, the petitioner filed an appeal under Section 6 of the U.P. Control of Goondas Act, 1970. Though, the appeal was admitted vide order dated 25.11.2025 however, the application for stay of the operation of the externment order dated 7.10.2024 was rejected.

Learned counsel for the petitioner submits that more than four months have passed and the appeal has yet not been decided. Therefore, he seeks stay of the externment order dated 7.10.2024 till the appeal is decided.

Learned A.G.A. on the other hand submits that the appeal shall be decided within such time frame as may be directed by this Court.

In view thereof, the instant petition is disposed of with a direction to the respondent no. 2 to decide the appeal of the petitioner within a period of three weeks from the date of communication of instant order.
