.Heard learned counsel for the petitioner and learned A.G.A for the State.

This Court had passed the following order on 22.03.2024:-

In response to our earlier orders, learned AGA has instructions to inform the Court that earlier a case Crime No. 168 of 2023 was registered on 13.04.2023 based on an incident which took place on 23.03.2023. The girl who is the subject matter of the missing report, Annexure-2 to the writ petition, was the victim of the said case and she was recovered, her statement was recorded under Sections 161 and 164 Cr.P.C. wherein she supported the prosecution case accordingly a charge-sheet was prepared against the accused who was juvenile on 25.07.2023 under Sections 363, 376 IPC, but, prior to it i.e. on 05.07.2023 the girl again went missing leading to the missing report Annexure-2 dated 05.07.2023. Efforts are being made to trace out the girl, but, till date no success has been achieved.

List in the 2nd week of May, 2024.

The Superintendent of Police, Shrawasti shall constitute a team for recovery of the girl and shall get the exercise monitored by a Senior Officer not below the rank of Additional Superintendent of Police. He shall file his own affidavit by the next date. "

Learned counsel for the petitioner submits that since the girl could not be recovered, therefore, the F.I.R dated 13.07.2024, Case Crime No.0275 of 2024, under Section 366 I.P.C lodged at Police Station Bhinga District Shrawasti but till date the girl has not been recovered and the investigation has not been done in terms of the directions issued by this Court.

Learned A.G.A also submits that the affidavit was filed on 14.05.2024 disclosing the efforts made to this Court.

In view of above, the Superintendent of Police, Shrawasti is directed to file an affidavit disclosing therein as to what efforts have been made by the Investigating Officer for recovery of the girl.
