Prayer no. 2 was withdrawn and the petition was dismissed as not pressed in respect of that prayer. Heard Sri Mohd. Salman, learned counsel for the petitioner and learned AGA.

This petition has been filed mainly for a direction for fair and proper investigation in F.I.R. vide Case Crime No.0459/2025, under Sections 189(2), 191(2), 324(4), 333, 115(2), 352, 351(3) BNS, Police Station Gangaghat, District Unnao.

Learned counsel for the petitioner submits that the investigation has not been conducted in a fair and proper manner, therefore, the petitioner has approached this Court. He also submits that inadvertently, the second prayer has been made, and prays that this petition may be dismissed as not pressed in regard to prayer no.2. To which there is no objection by the other side.

In view of above, this petition is dismissed as not pressed in regard to prayer no.2. Now this petition survives only in regard to prayer no.1, which is extracted hereinbelow:-

"(i) issue writ, order or direction in the nature of mandamus directing the opposite party no.2 to 7 to ensure fair and proper investigation into the matter lodged by the petitioner registered as 0459/2025, under Sections 189(2), 191(2), 324(4), 333, 115(2), 352, 351(3) BNS, Police Station Gangaghat, District Unnao."

Learned AGA, on the basis of instructions dated 30.10.2025, received from Ravindra Narayan Chaubey, Sub Inspector, Police Station Gangaghat, District Unnao,which has been placed before this Court and taken on record, submits that the investigation is going on and the accused are being searched and the investigation shall be completed expeditiously in fair and impartial manner.

In view of above, the petition is disposed of in terms of statement of learned AGA with liberty to the petitioner to approach to the concerned court in view of the judgment of the Honb'le Supreme Court in the case of Sakiri Vasu vs. State of Uttar Pradesh and others; (2008) 2 SCC 409, in case the occasion arises.
