This application has been filed on behalf of the appellant for suspension of sentence and to stay sixth condition mentioned in the impugned judgment, whereby the appellant was directed to deposit an amount of Rs.1,50,000/- as compensation.

The appellant has been convicted by the trial court under Section 4 D.P. Act and he was released on probation subject to condition that he shall deposit an amount of Rs.1,50,000/- as compensation.

Learned counsel for the appellant submitted that appellant is father-in-law of victim. Referring to statements of witnesses and facts of the matter, it was submitted that there is no credible evidence to convict the appellant under Section 4 D.P. Act. It was submitted that appellant was released on probation by the trial Court but subject to condition that he shall deposit an amount of Rs.1,50,000/- as compensation. Learned counsel submitted that condition is quite arbitrary and this direction may be kept stayed during pendency of the appeal.

Considering the submissions of learned counsel for the parties, nature of evidence and all attending facts and circumstances of the case, it is directed that realization of the amount of compensation of Rs.1,50,000/- mentioned in sixth condition of judgment shall remain stayed during the pendency of this appeal.

The application under Section 430(1) BNSS is disposed of accordingly.
