Heard Sri Gokaran Singh, learned counsel for appellants and learned A.G.A. for the State as well as perused the record.

The instant appeal has been filed for seeking quashing of the impugned summoning order dated 31.10.2023 passed by Special Judge, SC/ST Act, Azamgarh in Complaint Case No. 7 of 2023, (Jharkhandey Prasad Vs. Dhanjay Singh and others), under Section 323, 504, 506 IPC and Section 3(1)Da, 3(1)Dha and 3(2)5 Ka of SC/ST Act, P.S. Raunapar, District Azamgarh.

Learned counsel for the appellants submits that co-accused Dhananjay Singh Patel, Mangaldeen and three others have, approached this Court in Criminal Appeals No.2425 of 2024 and 6479 of 2024, which were disposed of by the co-ordinate Bench of this Court vide orders dated 29.8.2024 and 9.8.2024 directing the court below to expedite and finalize the proceedings of the aforesaid case expeditiously as possible, preferably within a period of 12 months from the date of presentation of a certified copy of this order before it without granting any unnecessary adjournments to either of the parties and further this Court has granted interim protection to the appellants that till the disposal of the proceedings, no coercive action shall be taken against the appellants, copy of the orders dated 29.8.2024 and 9.8.2024 passed on, are kept on record.

Learned Standing Counsel has opposed the prayer as made in the appeal.

Considering the submission made by learned counsel for the appellants, the present appeal stands disposed of in terms of the directions given by this Court in Criminal Appeals No.2425 of 2024 and 6479 of 2024.
