Heard learned counsel for the appellant, learned A.G.A for the State as also perused the record.

The present criminal appeal under Section 14-A(1) Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act has been preferred to set aside the impugned order (u/s 319 Cr.P.C.) dated 19.07.2024 passed by Special Judge (SC/ST Act) Mainpuri in Special Sessions Trial No.27 of 2010 (State of U.P. vs. Vipin Kumar) arising out of Case Crime No.539 of 2009, under Sections 307, 506 IPC and Section 3(2)V of SC/ST Act, Police Station Kishni, District Mainpuri.

During arguments, learned counsel for the appellant has submitted that he does not want to press the prayer made in the appeal. His sole prayer is that a direction may be issued to the court below to decide the bail application of the appellant in accordance with law.

Considering the facts and circumstances of the case, the present appeal is disposed of with the direction that in case the appellant filed bail application before the court below, the same shall be heard and disposed of expeditiously in accordance with law.

With the above observations, this appeal is disposed of finally.
