Allahabad High Court, Lucknow Bench (Ram Manohar Narayan Mishra, J.) — Criminal Appeal No. 3750 of 2024, decided December 16, 2025. Accused-appellants (Brijesh Tripathi and another) had challenged the summoning order dated 04.01.2012 passed by the trial court alongwith the entire proceedings of Case Crime No. 449 of 2011, Police Station Jhageerganj, District Ambedkar Nagar, registered under Sections 147, 148, 323, 504, 506, 452, 336, 427 IPC, Section 7 CLA Act and Section 3(1) x of the SC/ST Act. Counsel submitted that the parties had reached a compromise, verified by the trial court on 22.08.2024 in the presence of the parties, that the offences were punishable with a maximum term of seven years' imprisonment, and that there was no embargo on quashing proceedings in terms of such a compromise. Respondent no.2 also filed a treasury chalan of Rs. 6250/- dated 11.12.2024 refunding the state assistance received by him to the State Exchequer pursuant to the Court's order dated 03.12.2024. Holding that the parties were no longer interested in proceeding with the criminal case, the Court quashed the proceedings of the said case crime in terms of the compromise entered between the parties and duly verified by the trial court, and disposed of the appeal in terms of the compromise.

Supplementary affidavit filed on behalf of the appellant, is taken on record.

Heard learned counsel for the appellants, learned A.G.A. for the State as well as learned counsel for respondent no.2 and perused the record.

Learned counsel for the respondent no.2 submits that the respondent no.2 has filed treasury chalan of Rs. 6250/- dated 11.12.2024 whereby he has refunded the state assistance received by him to State Exchequer in pursuant of the order of this Court dated 03.12.2024.

Learned counsel for the parties submit that the parties reached a compromise and they are no longer interested to proceed with the criminal case regarding which present appeal has been preferred by the accused persons with the prayer to quash the summoning order dated 04.01.2012 passed by the trial court alongwith entire proceedings of Case Crime No. 449 of 2011 under Sections 147,148, 323, 504, 506, 452, 336, 427 IPC and 7 CLA Act and 3(1) x of SC/ST Act of Police StationJhageerganj, District- Ambedkar Nagar.

He next submitted that the offenses are punishable with a maximum term of 7 years of imprisonment and there is no embargo in quashing the proceedings of the trial court in terms of compromise arrived between the parties and duly verified by the trial court.

He also submitted that the parties had filed compromise before the trial court which has been duly verified on 22.08.2024 by the trial court in presence of the parties.

In view of the above, the proceedings in aforesaid case crime, as stated above, are hereby quashed in terms of compromise entered between the parties and duly verified by the trial court.

The appeal stands disposed of in terms of the compromise.
