Learned A.G.A. files counter affidavit on behalf of State. The same is taken on record.

Heard, Sri Suraya Prakash, learned counsel, holding the brief, appearing for the appellant and learned A.G.A. for the State.

The office report dated 28.11.2025 reveals that opposite party no.2 has been sufficiently served, despite sufficiency of service, none appeared for opposite party no.2 to contest the appeal.

Learned counsel submits that the F.I.R. has been lodged by the victimopposite party no.2 for the offence under Sections 323, 504, 506 I.P.C. and 3(1) (द)(ध) of SC/ST Act in Case Crime No.279 of 2024 Police Station Tambaur, District Sitapur. The informant has alleged in the F.I.R that at about 1.00 p.m. on 30.06.2024 four persons including the appellant hurled caste related abuses and wielded cane and lathi blow on informant a her husband and one Amrish, the son of her brother-in-law. The dispute was plucking of mangoes. Four persons have been mentioned in the F.I.R.The victim suffered simple injuries. After investigation charge-sheet is submitted against two persons. There is no separate role assigned to the appellant. The co-accused, Upendra has already been granted bail by Exclusive Court of SC/ST Act, hence prayed that bail may be granted to the accused-appellant.

Learned A.G.A. opposes the bail application and submits that the accusedappellant has been charge-sheeted. Both the injured have named the

accused-appellant in their statements. The injuries on the person of Amrish were kept under observation, hence, he seeks rejection of bail.

Considering the injuries on the person of injured, no specific role of the accused-appellant, the appellant shall be enlarged on bail and the appeal deserves to be allowed.

7. Accordingly, the appeal is allowed.

The order dated 15.10.2025 passed by Special Judge, (SC/ST Act), Sitapur in Bail Application No.334 of 2025 (Sagar Versus State of U.P. ) arising out of Case Crime No.279 of 2025 under Sections 323, 504, 506 I.P.C. and 3(1)(द)(ध) of SC/ST Act Police Station Tambaur, District Sitapur, is set aside.
