Heard learned counsel appearing for the appellants and learned Additional Government Advocate appearing for the State.

The captioned criminal appeal has been filed challenging therein, the order dated 05.07.2025 passed by the learned Additional Sessions Judge/Special Judge (SC/ST) Act, Gonda in Sessions Case No.925 of 2025, whereby the appellants had been summoned to face trial for the offences punishable under Sections 115(2), 352, 351(3) of B.N.S., 2023 and Sections 3(2)5A, 3(1)(r), and 3(1)(s) of SC/ST Act, Police Station-Katra Bazar, District-Gonda.

Learned counsel appearing for the appellants, at the very outset, has submitted that the appellants intend to surrender before the trial court and shall file the application for grant of bail. He has further submitted that this Court may direct the trial court to consider and decide the appellants' application for bail in the light of law laid down by the Hon'ble Supreme Court in its judgment rendered in the case of Satendra Kumar Antil vs. Central Bureau of Investigation and another, reported in (2022) 10 SCC 51.

Learned Additional Government Advocate appearing for the State does not have any objection if the aforesaid limited prayer is allowed in favour of the appellants.

In view of the aforesaid submissions, this criminal appeal is disposed of with liberty to the appellants to surrender before the trial court concerned and file the application for bail within a period of four weeks from today and

if such application is filed, the trial court is hereby directed to consider and decide the said application, expeditiously keeping in view the law laid down by Hon'ble Supreme Court in the case of Satendra Kumar Antil (supra) .
