This criminal appeal U/S 415(II) of BNS has been filed by the appellant for setting aside the judgment and order of learned Additional Sessions Judge/Special Judge (POCSO Act), Bahraich dated 07.07.2025 in Special Criminal Case No. 296 of 2023 arising out of Case Crime No. 323 of 2022 P.S. Hardi District Bahraich whereby the appellant has been convicted under Section 376, 506 of IPC, Section 3/4(I) of POCSO Act and Section 3(2)(V) of SC/ST Act and sentenced under Section 4(1) of POCSO to undergo for the period of ten years imprisonment with fine of Rs. 50000/- in default of payment of fine five months additional imprisonment, under Section 3(2)(V) SC/ST Act to undergo for the period of ten years imprisonment with fine of Rs. 50000/- in default of payment of fine five months additional imprisonment and under Section 506 IPC to undergo with two years imprisonment with fine of Rs. 10000/- in default of payment o0f fine one month additional imprisonment.

Office is directed to summon the original records of the lower court before the next date of listing.

Registry shall ensure that the original records are produced on the next date of listing.

In the meantime, the State shall also file its objection and serve copy upon the learned counsel for the appellant.
