The case was taken up in the revised call, however none was present for the victim-complainant. After the argument advanced and leaving the Court by appellant's counsel, the victim-complainant alongwith the learned Amicus Curiae appeared before the Court and stated that they could not attend the Court at the time of hearing of the case, due to traffic jam.

At this situation, on the direction of the Court for hearing the victimcomplainant counsel in the presence of counsel for the appellant, when the officials of this Court tried to contact the appellant's counsel, he did not turn up, even he did not pick up the phone call, therefore, list/put up this case before another Bench.
