Chatar Singh and 2 Others vs State of U.P.

Learned counsel for the appellants submitted that the trial court has not appreciated evidence in correct perspective and there is no credible evidence against the appellants. Learned counsel has referred the statements of informant and other witnesses and submitted that there are material contradictions and infirmities in the prosecution version. It is further submitted that during trial appellants were on bail and after conviction they have been released on interim bail by the trial Court. Lastly, it was submitted that in view of huge pendency of cases, there is no possibility of early hearing in the appeal and thus, in view of the aforesaid facts and circumstances of the case, the appellants may be granted bail during pendency of appeal.

Learned A.G.A. has opposed the application and submitted that conviction of the appellants is based on evidence and that no case for suspension of sentence is made out.

Considering submissions of learned counsel for the parties, nature of evidence and all attending facts and circumstances of the case, without expressing any opinion on the merits, a case for suspension of sentence / grant of bail is made out. Hence, application for suspension of sentence / bail application is hereby allowed.

Let the appellants - Chatar Singh, Narayan Singh and Ajay Singh convicted and sentenced in S.T. No. 1047 of 2024, arising out of Case Crime No. 184 of 2016, under Sections -

452, 323, 436, 504, 506 I.P.C., Police Station - Chhata, District - Mathura, be released on bail on their furnishing a personal bond with two sureties (one should be of their family member) each in the like amount to the satisfaction of the court concerned.

On acceptance of bail bonds and personal bond, the court concerned shall transmit photostat copies thereof to this Court for being kept on the record.
