Heard Mr. Najam Uz Zaman Khan, learned counsel for the appellants and learned A.G.A for the State as also perused the record.

The present criminal appeal under Section 14-A(1) Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act has been preferred to set-aside the impugned charge-sheet no.01 of 2024 dated 22.10.2024 as well as cognizance/summoning order dated 28.11.2024 passed by Special Judge SC/ST Act, Hathras in Criminal Misc. Case No.553 of 2024 (State Vs. Sachin and others) arising out of Case Crime No. 183 of 2024, under Sections 115(2), 352 B.N.S. and Section 3(1)(r) and 3(1)(s) of SC/ST Act, Police Station- Hasaayan, District- Hathras with a further prayer to stay further proceedings of the aforesaid case.

During arguments, learned counsel for the appellant has submitted that he does not want to press the prayer made in the appeal. His sole prayer is that a direction may be issued to the court below to decide the bail application of the appellant in view of the judgment in the case Satender Kumar Antil vs. Central Bureau of Investigation and another, 2021 SCC Online SC 922.

Considering the facts and circumstances of the case, the present appeal is disposed of with the direction that in case the appellantsfiled bail application before the court below, the same shall be heard and disposed of expeditiously by the court below in view of the settled law laid by this Court in the case of Satender Kumar Antil (Supra).
